Agreement and scope
These Terms of Use ("Terms") govern your access to Calm Now / Calma Agora, including our mobile app, web app, and website at calmnow.click (the "Services"), operated by Calm Now / Calma Agora ("we," "us," or "our"). By using the Services, you agree to these Terms and our Privacy Policy. Use of the mobile app is also subject to our End User License Agreement (EULA) at /eula. If you do not agree, do not use the Services.
Not medical advice
Calm Now is a wellness and mental-regulation practice tool. It does not provide medical advice, diagnosis, or treatment. Content and exercises are for educational and self-help purposes only.
Not a substitute for professional care
Do not use Calm Now as a substitute for professional mental health care, therapy, or emergency services. If you are in crisis or may harm yourself or others, contact emergency services or a qualified professional immediately.
Eligibility and account security
You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@calmnow.click of any unauthorized use.
Acceptable use
You agree not to misuse the Services, including by attempting unauthorized access, scraping or harvesting data, reverse engineering the app except where law permits, interfering with security or performance, or using the Services for unlawful purposes.
Intellectual property
We own or license the content, software, trademarks, and other materials in the Services. We grant you a limited, personal, non-transferable license to use the Services as intended. You may not copy, modify, distribute, or create derivative works except as allowed by law or with our written permission.
App Store and Google Play
If you download the app through the Apple App Store or Google Play, your use is also subject to that store's terms. Apple and Google are not responsible for providing maintenance or support for the app and are third-party beneficiaries of applicable store license terms.
Payments
The current version of the Services does not include in-app purchases or paid subscriptions. If we introduce payments in the future (for example through app stores or Stripe), we will update these Terms and provide applicable billing terms before you are charged.
Disclaimer and limitation of liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
Governing law and jurisdiction
These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Courts in Portugal shall have jurisdiction, subject to mandatory consumer protections in your country of residence.
Changes and contact
We may update these Terms from time to time. Continued use after the updated date constitutes acceptance where permitted by law. Material changes will be communicated through the app or website. Questions: support@calmnow.click.
